The Public Utilities Commission meeting will be held in Room 400, City Hall, 1 Dr. Carlton B. Goodlett Place, San Francisco, CA. The Commission meeting room is wheelchair accessible. The closest accessible BART station is the Civic Center Station at United Nations Plaza and Market Street. Accessible MUNI lines serving this location are: #47 Van Ness, and #71 Haight/Noriega and the F Line to Market and Van Ness and the Metro Stations at Van Ness and Market and at Civic Center. There is accessible curbside parking adjacent to City Hall on Grove Street and Van Ness Avenue and in the vicinity of the Veterans Building at 401 Van Ness Avenue adjacent to Davies Hall and the War Memorial Complex.

(a) BAWSCA Update

THE FOLLOWING MATTERS BEFORE THE PUBLIC UTILITIES COMMISSION ARE RECOMMENDED FOR ACTION AS STATED BY THE GENERAL MANAGER OF PUBLIC UTILITIES AND CITY ATTORNEY WHERE APPLICABLE.

CONSENT CALENDAR

9. All matters listed hereunder constitute a Consent Calendar, are considered to be routine by the San Francisco Public Utilities Commission, and will be acted upon by a single vote of the Commission. There will be no separate discussion of these items unless a member of the Commission or the public so requests, in which event the matter will be removed from the Consent Calendar and considered as a separate item.

a) Staff Recommendation:

Ratify the Declaration of Emergency made by the General Manager of the San Francisco Public Utilities Commission, dated March 6, 2008 and approved by the President of the Commission for contract work consisting of repairing the North Point Force Main on the Embarcadero at Washington Street.

b) Staff Recommendation:

Approve the plans and specifications and award Water Enterprise Water System Improvement Program-funded Contract No. WD-2525, Mount Davidson Storage Tank and Pump Station Upgrade, in the amount of $3,987,800, to the lowest, qualified, responsible and responsive bidder, NTK Construction

REGULAR BUSINESS

10. Discussion of the powers and duties of the Commission, Commissioners and General Manager pursuant to the San Francisco Charter and a proposed amendment to the SFPUC Rules of Order. (Continued from the regular meeting of April 8, 2008) (Ambrose)

11. Discussion and possible action related to approve Project No. CUH93101 Hetch Hetchy Communications System Upgrade Project; adopt the required California Environmental Quality Act (CEQA) Findings and Mitigation Monitoring and Reporting Program (MMRP). (Torrey)

Staff Recommendation:

Approve Hetch Hetchy Water & Power (HHW&P)-funded Project No. CUH93101, Hetch Hetchy Communications System Upgrade Project; adopt the required California Environmental Quality Act (CEQA) Findings and Mitigation Monitoring and Reporting Program (MMRP) with respect to the Final Mitigated Negative Declaration for the project.

12. Discussion and possible action related to authorize the General Manager of the San Francisco Public Utilities Commission (“SFPUC”) to execute documents necessary to continue use of the existing $250 million Water Enterprise commercial paper program (the “Program”), which is used to fund Water System Improvement Program (“WSIP”) projects between the issuances of long-term revenue bonds. (Yew)

Staff Recommendation:

Authorize the General Manager of the San Francisco Public Utilities Commission (“SFPUC”) to execute documents necessary to continue use of the existing $250 million Water Enterprise commercial paper program (the “Program”), which is used to fund Water System Improvement Program (“WSIP”) projects between the issuances of long-term revenue bonds.

PROFESSIONAL SERVICE CONTRACTS

13. Discussion and possible action related to approve Agreement No. CS-866 and authorize the General Manager to negotiate and execute a professional services agreement with Wendel, Rosen, Black & Dean, LLC. (Dowd)

Staff Recommendation:

Approve the selection of Wendel, Rosen, Black & Dean, LLC; award Professional Services Agreement No. CS-866, Real Estate/Land Use Negotiation Services; and authorize the General Manager of the San Francisco Public Utilities Commission to negotiate and execute a professional services agreement with Wendel, Rosen, Black & Dean, LLC, for an annual budgeted amount of $100,000 per year for a total budgeted amount not to exceed $500,000, and with a duration of five (5) years, or, in the event negotiations are not successful or City requirements are not satisfied, to negotiate and execute a professional services agreement with the next highest ranked proposer.

14. Discussion and possible action related to authorize the General Manager to negotiate and executive a professional services Agreement No. CS-910 with ARA engineering and with a duration of 60 months, or in the event negotiations are not successful or City requirements are not satisfied, to negotiate and execute a professional services agreement with the next highest ranked proposer. (Labonte)

Staff Recommendation:

Approve the selection of ARA Engineering; award Water Enterprise Water System Improvement Program-funded Agreement No. CS-910, San Francisco Region/Local Construction Management Services for the Water System Improvement Program, to provide construction support; and authorize the General Manager of the San Francisco Public Utilities Commission to negotiate and execute a professional services agreement with ARA Engineering for an amount not to exceed $7,000,000, and with a duration of 60 months, or, in the event negotiations are not successful or City requirements are not satisfied, to negotiate and execute a professional services agreement with the next highest ranked proposer.
